The immigration laws can seem like a labyrinth. In addition to complicated immigration statutes and regulations, federal immigration law as a whole includes agency interpretations, decisions by the Board of Immigration Appeals, and Federal decisions.

Of course, there are times when the immigration statutes and the immigration regulations do not provide complete guidance as to how federal immigration law should be applied in a particular case. This is because, even though there are many similarities in the same types of immigration cases, the details regarding the people involved are often very different.

Agency Interpretations

The previous segment provided a brief description of one of the components of federal immigration law, the immigration regulations.

In this segment we describe another one of the main sets of "rules" that you may have to be aware of in order to maximize your chances of success with your immigration case. Taken together, all of this information may help you determine whether you need an immigration lawyer.

To recap, the federal immigration statutes which make up the INA are the foundation of current federal immigration law in the United States. And, the federal immigration regulations in the CFR specify the government's interpretation of those federal immigration statutes.

Additionally, there are situations in which the immigration statutes and the immigration regulations do not at all or fully address some particular collateral issue. In those circumstances, United States Citizenship and Immigration Services (USCIS), the federal agency that oversees lawful immigration to the United States, provides further guidance through its agency interpretations.

Continuing with our previous examples regarding work authorization, if USCIS were to determine that a particular statute and the pertinent regulations were ambiguous, the agency might issue an agency interpretation via a Policy Memorandum. A simplified example of one such memorandum might contain language such as, "Although the statutory language of _____ provides for work authorization, it is not clear whether it applies to _____." The memorandum would then spell out the agency's interpretation and would provide a directive to the USCIS officers to decide the specified cases a certain way in order to promote uniformity.

USCIS also provides agency interpretations through the decisions issued by the Administrative Appeals Office (AAO) which reviews appeals of denials of all kinds of petitions and applications for immigration benefits. The agency interpretations contained in the detailed immigration memorandums and the AAO decisions can be found at the USCIS website.

You should be familiar with all the immigration "rules" that may apply to your case based on your individual situation so that you will have a better chance of a positive outcome.
